Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and THE QUIZ MACHINE COMPANY LIMITED ("Company," "we," "us," or "our"), a company registered in England and Wales, concerning your access to and use of the MyBookie mobile application ("App").

By downloading, installing, or using MyBookie, you agree to be bound by these Terms. If you disagree with any part of these Terms, you must not use our App. MyBookie is provided completely free of charge with no hidden fees, subscriptions, or in-app purchases.

License to Use

2.1 Grant of License

Subject to your compliance with these Terms, THE QUIZ MACHINE COMPANY LIMITED grants you a limited, non-exclusive, non-transferable, revocable license to download and use MyBookie on your personal iOS devices for your personal, non-commercial use at no cost.

2.2 License Restrictions

You agree NOT to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Sell, rent, lease, sublicense, or distribute the App
• Remove any proprietary notices or labels from the App
• Use the App for any illegal or unauthorized purpose
• Violate any applicable laws in your jurisdiction
• Attempt to gain unauthorized access to the App's code or systems
• Use the App for commercial purposes without our written consent

2.3 iOS Requirements

MyBookie requires iOS 26.0 or later and utilizes Liquid Glass design features. The App is optimized for iPhone and iPad devices. Performance may vary based on your device specifications. The App is provided free of charge for all compatible devices.

User Accounts and Data

3.1 No Account Required

MyBookie does not require account creation or registration. All data is stored locally on your device using Apple's SwiftData framework. You are responsible for maintaining the security of your device and the data stored within the App.

3.2 User-Generated Content

You retain all rights to the financial data and information you input into MyBookie ("User Content"). By using the App, you grant us a limited license to process this data locally on your device solely to provide the App's functionality. We do not access, collect, or monetize your data in any way.

3.3 Data Accuracy

You are solely responsible for the accuracy and legality of all financial information you enter into the App. MyBookie is a tracking tool and does not provide financial advice.

Free App Terms

4.1 No Fees or Charges

MyBookie is provided completely free of charge. There are:

• No subscription fees
• No in-app purchases
• No premium features
• No hidden costs
• No advertisements
• No data selling or monetization

4.2 Full Feature Access

All users have access to the complete set of MyBookie features including:

4.3 No Future Monetization

We commit to keeping MyBookie free. If we ever introduce optional paid features in the future, existing features will remain free and accessible to all users.

Prohibited Uses

You may not use MyBookie:

1. For any unlawful purpose or to solicit others to perform unlawful acts
2. To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
3. To infringe upon or violate our intellectual property rights or the intellectual property rights of others
4. To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
5. To submit false or misleading information
6. To upload or transmit viruses or any other type of malicious code
7. To interfere with or circumvent the security features of the App
8. To attempt to extract or reverse engineer the source code
9. To collect or track personal information of others
10. To spam, phish, pharm, pretext, spider, crawl, or scrape

Intellectual Property Rights

6.1 Our Intellectual Property

The App and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of THE QUIZ MACHINE COMPANY LIMITED and its licensors. The App is protected by copyright, trademark, and other laws of the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6.2 Feedback

If you provide us with any feedback, suggestions, or ideas regarding the App ("Feedback"), you grant us a worldwide, perpetual, irrevocable, royalty-free license to use such Feedback for any purpose without compensation to you.

6.3 Third-Party Licenses

MyBookie uses open-source libraries and Apple's frameworks under their respective licenses. A full list of third-party licenses is available within the App's settings.

Disclaimers and Limitation of Liability

7.1 Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE QUIZ MACHINE COMPANY LIMITED EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 Limitation of Liability

IN NO EVENT SHALL THE QUIZ MACHINE COMPANY LIMITED, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.

7.3 Maximum Liability

Since MyBookie is provided free of charge, our total liability to you for all claims arising out of or relating to these Terms or the App shall not exceed £10 GBP.

Termination

8.1 Termination by You

You may terminate these Terms at any time by deleting the App from your device. Upon deletion, all locally stored data will be permanently removed. There are no cancellation fees or penalties as the App is completely free.

8.2 Termination by Us

We reserve the right to terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

8.3 Effect of Termination

Upon termination, your right to use the App will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law and Disputes

9.1 Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

9.2 Jurisdiction

Any legal action or proceeding relating to your access to, or use of, the App shall be instituted in a court of competent jurisdiction in Essex, England, and you submit to the jurisdiction of such courts.

9.3 Dispute Resolution

Before initiating any legal proceedings, you agree to attempt to resolve any dispute through good faith negotiation by contacting us at owner@the-quiz-machine-company.com. We will attempt to resolve the matter within 30 days of receiving your notice.

Additional Terms

10.1 Indemnification

You agree to defend, indemnify, and hold harmless THE QUIZ MACHINE COMPANY LIMITED and its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the App or violation of these Terms.

10.2 Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

10.3 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and THE QUIZ MACHINE COMPANY LIMITED regarding the use of the App, superseding any prior agreements.

10.4 Modifications to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide notice through the App at least 30 days before new terms take effect. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

10.5 Assignment

You may not assign or transfer these Terms or your rights under these Terms, in whole or in part, without our prior written consent. We may assign our rights and obligations without restriction.

Acknowledgment

BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTOOD THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU CANNOT USE THE MYBOOKIE APP.

You acknowledge that MyBookie is provided free of charge and accept it with all its features and limitations.
